2. Service Description
UpNova is an AI-powered professional growth platform that helps individuals build self-awareness about their evolving capabilities. The platform provides skill and trait profiling, AI fluency assessment, accomplishment journaling, peer feedback calibration, and AI-generated growth insights.
UpNova is a professional development tool. It is not a recruitment platform, credentialing authority, or employment decision system. Outputs from the platform — including AI-generated narratives, proficiency scores, and impact reports — are informational aids designed to support self-directed professional growth.
3. Accounts & Authentication
3.1 Account Creation
You create an account by authenticating through a supported OAuth provider. The list of supported providers is displayed on the login page and may change over time. We do not store passwords. You are responsible for maintaining the security of your OAuth provider account.
3.2 Eligibility
You must be at least 18 years of age to use UpNova. By creating an account, you represent that you meet this requirement.
3.3 One Account Per Person
Each individual may maintain one UpNova account. If you change organizations, contact support to migrate your account rather than creating a new one.
4. Data Ownership & Classification
4.1 Your Data, Your Mirror
You retain all rights to the data you create on UpNova. We do not claim ownership of your accomplishments, self-assessments, goals, values, or journal entries.
4.2 Data Tiers
UpNova classifies data into two tiers, each with distinct visibility and control rules:
Tier 1 — Personal Growth Data includes your self-reads, accomplishment narratives, personal goals, values, journal entries, and AI fluency assessment responses. This data is visible only to you. Organization administrators and team leads cannot access identifiable Tier 1 data.
Tier 2 — Shared Growth Data includes peer feedback you give or receive (Growth Syncs), conversation signals from 1:1 Syncs, team-level snapshots, and coaching signals. You explicitly consent to sharing Tier 2 data when you participate in collaborative features. Visibility follows role-based access rules — team leads see coaching context for direct reports; organization administrators see team-level aggregates only.
4.3 License Grant
You grant us a limited, non-exclusive, non-transferable license to process your data solely for the purpose of providing the UpNova service — including AI-powered analysis, insight generation, and report creation. We do not use your identifiable personal data to train AI models, sell your data to third parties, or serve advertising. If we introduce model training using anonymized, aggregated data in the future, we will update these Terms with at least 30 days' notice.
4.4 Data Portability
You may request a copy of your data by contacting admin@upnova.ai. We will provide your data in a structured, machine-readable format within 30 days.
5. AI-Generated Content
5.1 Nature of AI Outputs
UpNova uses AI to generate accomplishment drafts, growth narratives, coaching insights, skill mappings, and impact reports. All AI-generated content is derived from your self-reported data and peer feedback.
5.2 Limitations & Disclaimers
AI-generated content on this platform reflects patterns in your self-reported data and activity. It is not a professional assessment, certification, credential, or employment recommendation. Specifically:
AI Fluency Profiles are scenario-based self-assessments with AI-assisted scoring. They indicate self-reported tendencies, not independently verified competencies.
Impact Reports synthesize your growth data into narrative form. They should not be presented to third parties as independently verified credentials.
You are responsible for reviewing, editing, and accepting any AI-generated content before relying on it or sharing it externally.
5.3 AI Transparency
We aim to make it clear when content has been generated or substantially assisted by AI, distinguishing it from user-authored content.
6. Organizational Use Policy
6.1 Purpose Limitation
Data accessed through UpNova by organization administrators and team leads shall be used solely for professional growth and development purposes. This includes team capability planning, coaching conversations, and development goal-setting.
6.2 Prohibited Organizational Uses
The following uses of UpNova data are prohibited:
Using UpNova data as the primary or sole basis for adverse employment actions including termination, demotion, performance improvement plans, or disciplinary proceedings.
Requiring or coercing employee participation in Growth Syncs, 1:1 Syncs, or self-assessments as a condition of employment.
Publicly disclosing individual peer feedback, perception gaps, or self-read scores outside the platform without the individual's explicit consent.
Using team-level analytics to rank, stack-rank, or compare individual team members for compensation or promotion decisions.
6.3 Enforcement
We reserve the right to investigate reports of misuse and to suspend or terminate organizational access if the Organizational Use Policy is violated. Users may report suspected misuse to admin@upnova.ai.
6.4 Transparency
We are committed to building transparency features that help users understand how their data is accessed within their organization. Users with questions about data access may contact admin@upnova.ai.
7. Peer Feedback Integrity
7.1 Voluntary Participation
Participation in Growth Syncs (peer feedback) and 1:1 Syncs is voluntary. No user may be penalized for declining to participate in or provide feedback through these features.
7.2 Feedback Confidentiality
Individual peer feedback is shared with the recipient in aggregated or attributed form as configured by the feedback mechanism. Feedback providers consent to the applicable visibility rules when they submit feedback. Retaliating against a colleague based on feedback content is a violation of these Terms.
7.3 Accuracy of Self-Reported Data
You are responsible for the accuracy of data you self-report, including accomplishments, self-reads, and assessment responses. AI-generated outputs (Impact Reports, capability portraits) reflect your inputs. Misrepresenting AI-generated outputs to third parties as independently verified credentials or certifications is prohibited.
8. Account Deletion
You may request permanent deletion of your account and all associated personal data by emailing admin@upnova.ai. Upon receiving a verified request:
Your account will be suspended immediately.
All personal data will be permanently deleted from production systems within 30 days.
Backup systems will purge your data within 90 days from the request date.
Deletion is irreversible. Data that has been permanently deleted cannot be recovered. If you leave an organization, your Tier 1 (Personal Growth Data) remains yours. Contact admin@upnova.ai to manage your account in this situation.
9. Acceptable Use
You agree not to:
Attempt to access another user's data without authorization.
Use automated tools to scrape, crawl, or extract data from the platform.
Reverse-engineer the platform's AI models, scoring algorithms, or ontology data.
Interfere with the platform's operation, security, or availability.
Use the platform for any purpose other than professional growth and development.
10. Intellectual Property
10.1 Platform Property
The UpNova platform, K2 skills and traits ontology (including skill definitions, proficiency rubrics, AI exposure classifications, and assessment scenarios), platform design, and underlying technology are the intellectual property of Praveen Selvam (Proprietorship).
10.2 User-Generated Content
11. Disclaimers & Limitation of Liability
11.1 Service Provided "As Is"
UpNova is provided on an "as is" and "as available" basis. We do not warrant that the service will be uninterrupted, error-free, or that AI-generated content will be accurate, complete, or suitable for any particular purpose.
11.2 No Professional Advice
Nothing on the platform constitutes career counseling, employment advice, legal advice, or psychological assessment. Consult qualified professionals for career decisions.
11.3 Limitation of Liability
To the maximum extent permitted by applicable law, our total liability to you for any claims arising from or related to these Terms or your use of UpNova shall not exceed the amount you paid to us in the 12 months preceding the claim, or INR 10,000, whichever is greater.
12. Governing Law & Dispute Resolution
12.1 Jurisdiction
These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Chennai, Tamil Nadu, India.
12.2 Geographic Scope
UpNova is currently offered to users in India. Users outside India may access the service at their own discretion; we make no representation regarding compliance with non-Indian regulations. When we expand to additional jurisdictions, supplementary regional terms will be published.
